Welcome to Jelly AI! We take your privacy seriously. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data when you use the Jelly AI iOS app and related services operated by Jelly AI Labs, Inc. (“Jelly,” “we,” “us,” or “our”).

By using Jelly AI, you agree to the collection and use of your information as described in this Privacy Policy. If you disagree, please stop using the app.

1. Information We Collect

We collect information in three main ways: information you give us directly, information generated by your use of the app, and information from third-party services.

1.1 Information You Provide

  • Account information: We may collect your name, email address, and profile details if you register or sign in.
  • Photos, selfies, and videos: Images and video clips you upload to use with our AI features. These are the primary input for creating AI-generated photos and videos. See Section 3 for full details on how we handle this data.
  • Payment information: Subscription and purchase details processed through Apple's in-app purchase system via RevenueCat. We do not store your payment card data directly.
  • Communications: Messages you send to our support team at support@getjelly.com.
  • Survey responses and feedback: Optional responses to in-app surveys or feedback requests.

1.2 Information We Collect Automatically

  • Usage data: Features you use, presets you select, content you create, and how you interact with the app.
  • Device information: Device model, iOS version, and unique device identifiers (IDFV).
  • App performance data: Logs, error reports, crash reports, and diagnostic data to keep Jelly AI running smoothly.
  • Attribution data: Install source and in-app event data for measuring marketing effectiveness (via AppsFlyer), subject to your iOS tracking preferences.

What we do not collect: We do not collect your contacts, call logs, or precise GPS location. With your permission (via Apple's App Tracking Transparency prompt), we may collect your IDFA for marketing attribution purposes through AppsFlyer. If you decline the ATT prompt, no IDFA data is collected.

1.3 AI-Generated Content

When you upload a photo or selfie, our AI models process that image to generate new photos or videos. The resulting AI-generated content (“Generated Content”) is associated with your user and stored so you can access it.

1.4 Data Categories Under CCPA/CPRA

For California residents, the categories of personal information we collect include:

  • Identifiers (name, email, device ID, IDFA (with your permission), IP address)
  • Commercial information (purchase history, subscription status, credit balance)
  • Internet or other electronic network activity information (usage data, feature interactions)
  • Geolocation data (general region only, derived from IP address; no precise GPS)
  • Sensitive personal information (uploaded photos — see Section 3.5)
  • Visual information (uploaded photos and AI-generated images/videos)
  • Inferences drawn from the above (anonymized feature usage preferences)

2. How We Use Your Information

We use the information we collect to:

  • Provide and operate the Jelly AI app and its AI features
  • Process your photos and videos through third-party AI model APIs to create Generated Content (see Section 3)
  • Manage your subscriptions and credit balance
  • Send you important notifications (subscription renewals, policy updates, security alerts)
  • Respond to support requests
  • Detect fraud, abuse, and enforce our Terms of Service
  • Comply with legal obligations
  • Analyze aggregate, anonymized usage trends to improve the product
  • Send you optional marketing communications (only with your consent; see Section 5.3 for opt-out)
  • Train and improve our AI models using your uploaded photos and Generated Content (see Section 3.3)

We do NOT use your personal information to:

  • Sell your personal information to third parties for their own marketing purposes
  • Make fully automated decisions about you that produce legal or similarly significant effects without human review

3. How AI Processes Your Photos — Detailed Disclosure

This section explains exactly how Jelly AI handles your photos and videos.

3.1 Upload and Processing

When you upload a photo or selfie, it is transmitted securely to our servers and forwarded to one or more third-party AI model APIs operated by fal.ai (https://fal.ai) and Replicate (https://replicate.com) to generate the output you requested.

3.2 Third-Party AI Model Providers

Your photos and videos are sent to the following third-party AI model providers to generate AI outputs:

 These providers process your content to generate your requested output. Each provider applies its own privacy
  policy, security controls, and content moderation. We share only the photo, video, or prompt necessary to
 fulfill your generation request; we do not share your account identifiers or contact information with these
 providers.

3.3 AI Model Training

By using Jelly AI, you agree that your uploaded photos, videos, and Generated Content may be used to train and improve our AI models. This training helps us enhance the quality and capabilities of Jelly AI's features for all users.

Specifically:

  • Your uploaded photos and Generated Content may be used to improve our AI models.
  • Training data may be retained for as long as necessary to improve our models, then deleted or permanently anonymized.
  • You may opt out of AI training at any time by contacting support@getjelly.com. Upon opting out, your content will no longer be used for future training, though previously trained models are not affected.

3.4 Photo and Video Retention

  • Uploaded source photos used for AI processing are deleted from processing servers promptly after generation completes.
  • Photos saved to your library are retained for as long as you keep them. You can delete them at any time within the app.
  • AI-Generated Content is retained for as long as you use the service. Download your content before deleting your data.
  • If your content is used for AI training, it may be retained for as long as necessary to improve our models, then deleted or permanently anonymized.
  • Analytics data is retained in anonymized or aggregated form and cannot be used to identify you.

You can request deletion of your photos at any time through the app or by emailing support@getjelly.com.

3.5 Photos Containing Faces

Your photos may contain facial features that are processed by our third-party AI model providers (fal.ai and
 Replicate) solely to generate your requested output.

 Jelly does not perform face detection, face recognition, face tracking, or any biometric processing on your
 photos. We do not extract, derive, or store biometric identifiers such as faceprints, face embeddings, or
 facial geometry from your photos.

 By uploading photos, you consent to the processing of any facial features contained in those images by our AI
  model providers for the sole purpose of generating your requested output.

4. Third-Party Services and Data Sharing

We work with third-party service providers to help operate and improve Jelly AI. These providers receive only the data necessary to perform their specific functions. These providers are expected to protect your data consistent with this Privacy Policy.

4.1 Analytics and Infrastructure Providers

We share specific data with the following third-party service providers, each under contractual agreements
 that limit their use of your data to the purposes described below:

4.2 When We May Share Your Information

  • With your consent: We will always ask before sharing your personal data for any purpose not described here.
  • Legal requirements: If required by law, subpoena, court order, or a valid government request. See Section 4.3 for our government data request policy.
  • Safety: To protect the rights, property, or safety of Jelly AI, our users, or the public.
  • Business transfers: If Jelly AI Labs, Inc. or any subsidiary is acquired or merges with another company, your data may be transferred as part of that transaction. We will notify you before your data becomes subject to a materially different privacy policy.
  • Aggregated/anonymized data: We may share aggregated or de-identified data that cannot reasonably be used to identify you.

We do NOT:

  • Sell your personal data to data brokers or third-party advertisers
  • Share your photos with unaffiliated third parties for their own independent purposes
  • Use your data for cross-context behavioral advertising

4.3 Government and Law Enforcement Data Requests

When we receive a government or law enforcement request for user data, our policy is to:

  • Notify you before complying (if legally permitted to do so), so you can seek legal relief if you choose
  • Comply only with requests that are legally valid and narrowly tailored to the specific user and information requested
  • Push back on overbroad or improperly issued requests

5. Tracking Technologies, Push Notifications, and Communications

5.1 Mobile App Tracking (iOS)

Jelly AI is a mobile app and does not use browser cookies. We and our third-party partners may use device identifiers and similar tracking technologies (such as IDFV on iOS, and IDFA with your permission) for analytics and attribution purposes.

You can limit ad tracking through iPhone Settings > Privacy & Security > Tracking. Limiting tracking may reduce our ability to measure marketing effectiveness but will not affect your use of Jelly AI’s core features. Jelly AI respects your iOS App Tracking Transparency (ATT) preference.

5.2 Cookie Policy (Web Version)

When the Jelly AI web application launches, it will use cookies and similar tracking technologies. At that time, this section will be updated with a full cookie disclosure. The web version will include:

  • Strictly necessary cookies (required for the service to function)
  • Analytics cookies (with your consent; opt-out available)
  • Marketing/advertising cookies (only with your explicit consent)
  • A cookie preference center allowing you to manage your choices at any time

We will provide notice and obtain your consent for non-essential cookies in accordance with applicable law (including GDPR, ePrivacy Directive, and state laws) before the web version launches.

5.3 Push Notifications and Marketing Communications

We may send you:

  • Transactional notifications: Subscription renewals, payment receipts, credit balance alerts, security alerts (cannot be opted out of while the service is active)
  • Product updates: New feature announcements and app updates (opt-out available in app Settings > Notifications)
  • Marketing messages: Promotional offers, discounts, and re-engagement messages (only with your explicit consent)

To opt out of marketing push notifications: Settings > Notifications > Marketing. To opt out of all non-transactional communications: Settings > Notifications > Off, or unsubscribe from any marketing email we send you.

6. Your Rights

6.1 Rights for All Users

Regardless of where you live, you may:

  • Access your data: Request a copy of the personal information we hold about you.
  • Delete your data: Delete your data at any time through app Settings.
  • Correct your information: Update inaccurate information through app Settings.

6.2 EU/EEA and UK Users (GDPR and UK GDPR Rights)

If you are located in the European Union, European Economic Area, or the United Kingdom, you have additional rights under GDPR/UK GDPR:

  • Right to data portability: Receive your data in a portable, machine-readable format.
  • Right to restriction: Ask us to pause processing of your data in certain circumstances (e.g., while a correction request is pending).
  • Right to object: Object to processing based on legitimate interests (such as analytics or AI model training), with effect unless we demonstrate compelling legitimate grounds.
  • Right to withdraw consent: Where we rely on your consent to process data, you may withdraw it at any time by contacting support@getjelly.com.
  • Right to lodge a complaint: With your local data protection authority (e.g., the ICO in the UK, your national DPA in the EU).
  • Right not to be subject to solely automated decision-making: Where we use automated processes that produce legal or significant effects, you may request human review.

Lawful bases for processing:

  • Contract performance (Art. 6(1)(b)): Providing the app and AI generation service, managing your subscriptions.
  • Legitimate interests (Art. 6(1)(f)): Fraud prevention, security, anonymized analytics, improving the service, AI model training.
  • Consent (Art. 6(1)(a)): Marketing communications, analytics tracking (web version).
  • Legal obligation (Art. 6(1)(c)): Responding to law enforcement requests, complying with tax laws.

6.3 California Residents (CCPA/CPRA Rights)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to Know: Request disclosure of the categories and specific pieces of personal information we have collected about you in the past 12 months, including the categories of third parties with whom we share it.
  • Right to Delete: Request deletion of your personal information, subject to certain exceptions (legal obligations, fraud detection, etc.).
  • Right to Correct: Request correction of inaccurate personal information.
  • Right to Opt Out of Sale/Sharing: We do not sell or share your personal information for cross-context behavioral advertising. You may still exercise this right by contacting us.
  • Right to Limit Use of Sensitive Personal Information: You may request that we limit use of your sensitive personal information strictly to providing the service. Submit this request via support@getjelly.com.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any CCPA/CPRA rights.

Response timeline: We will respond to your request within 45 calendar days (extendable by 45 days with notice for complex requests). We will verify your identity before fulfilling access or deletion requests.

6.4 Washington Residents (My Health My Data Act)

Washington residents have rights under the My Health My Data Act regarding health-related data. We do not collect, share, or sell health data. You may request deletion of your data at any time by contacting support@getjelly.com.

6.5 Colorado Residents

Colorado residents have rights under the Colorado Privacy Act (CPA), including the right to opt out of the processing of personal data for targeted advertising (which we do not engage in), profiling, and the sale of personal data (which we do not do). To exercise your Colorado privacy rights, contact support@getjelly.com.

7. Children’s Privacy

Jelly AI is not directed to children under 13 years of age, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not use Jelly AI or provide any information to us.

EU/EEA/UK users must be at least 16 years old to use Jelly AI (or such higher age as required by applicable local law). For users in other jurisdictions, we rely on parental consent for users under 13.

If we learn we have collected personal information from a child under the applicable minimum age, we will delete that information promptly. Parents or guardians who believe we may have inadvertently collected information from a child should contact support@getjelly.com.

If you upload photos depicting minors, you represent and warrant that you have lawful authority (such as parental rights or guardian status) to consent to the processing of those images.

8. Security

We implement commercially reasonable measures to protect your data, including encryption in transit and at rest, access controls, and security monitoring. No method of transmission over the internet or electronic storage is 100% secure. While we use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

9. Data Retention and Deletion

We retain your personal information for as long as necessary to provide the Jelly AI service and for legitimate business purposes. When data is no longer needed, it is deleted or permanently anonymized. Payment records may be retained as required by tax and financial compliance laws.

You can request deletion of your data at any time through app Settings or by emailing support@getjelly.com. You may stop all future data collection by uninstalling the app from your device.

10. International Data Transfers

Jelly AI Labs, Inc. is based in the United States. By using Jelly AI, you understand that your information may be transferred to and processed in the United States and other countries where our service providers operate, which may have different data protection laws than your country of residence. We take reasonable steps to ensure your data is treated securely and in accordance with this Privacy Policy.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you through a prominent in-app notice or email before the changes take effect (at least 14 days’ advance notice for material changes). The “Last Updated” date at the top reflects the most recent revision.

Your continued use of Jelly AI after any changes become effective constitutes your acceptance of the revised Privacy Policy. If you do not agree to the changes, you may delete your data before the new policy takes effect.
